Sale of a motor vehicle or any other kind of unregisterable movable property, like home appliances, inventory of stocks in trade, need not be in writing to be valid and enforceable. However, the Land Transportation Office requires a deed of sale to register the sale of a motor vehicle and transfer the Certificate of Registration in her name of the buyer. The LTO is the primary government registry of all motor vehicles. A deed of sale will also ensure the protection to the parties in case ownership of the vehicle is put in question. The law on warranties and hidden defects in a contract of sale under the Civil Code applies to motor vehicle.
